INSPECTIONS AND CONVICTIONS
10.1 The Factory Inspectorates in various States/Union Territories inspect the factories to ensure that there is no infringement of the provisions of the Factories Act, 1948. Table 9.1 gives information relating to frequency of inspections etc. during the year 2002. The factories, which were not inspected, constituted 52.37 percent of the total number of factories on register. Out of 77887 factories inspected, 69701 (89.49 percent) were inspected only once in the year 2002.
10.2 Convention No.81 (Article 21) of the International Labour Organisation required that information relating to the number of Inspectorate Staff under the Factories Act, 1948 may be collected. Such information for the year 2002 relating to various States/Union Territories may be seen in Table 9.2.
10.3 The Inspectorate Staff enquired into complaints lodged by individual workers, trade unions, private persons, etc. regarding infringement of the provisions of the Factories Act, 1948 and took suitable action, wherever necessary.
The number of convictions obtained against the factory management for infringement of various provisions of the Factories Act, 1948 in various States/Union Territories during 2002 are given in Table 9.3. The maximum number of such convictions i.e. 1569 were reported by the Tamil Nadu State. Out of the total number of 3522 convictions, 833 pertained to the offences relating to Notices, Registers and Returns.
